Asylum Services: Protecting Your Right to Safety
At The Law Office of Iris V. Anderson, we are committed to helping individuals seek protection through asylum in the United States. If you fear returning to your home country due to harm or persecution, we are here to guide you through the asylum process with compassion and expertise.
Who Qualifies for Asylum?
You may be eligible to apply for asylum if you are afraid to return to your home country due to harm or the risk of persecution based on:
Political opinion
Religion
Race
Nationality
Membership in a particular social group
Our Asylum Services
1. Affirmative Asylum Applications
Applications must generally be filed within one year of your last entry into the U.S. Exceptions may apply for specific circumstances.
After filing, you will be interviewed by a USCIS asylum officer.
Need an earlier interview? We can help you request placement on the short notice list or explore options for an expedited interview.
2. Defensive Asylum Applications (Removal Proceedings)
If you are in removal proceedings, you can apply for asylum defensively before an Immigration Judge.
The judge reviews your case independently and gives you another opportunity to prove your fear of returning to your home country.
If asylum is denied but persecution is established, you may still qualify for:
Withholding of Removal (WOR)
Relief under the Convention Against Torture (CAT)
3. Nunc Pro Tunc Asylum Applications
If a spouse or child of an asylee loses derivative status, they may file an independent asylum application through a nunc pro tunc application.
4. Family Petitions for Asylees
Once asylum is granted, you can file for your spouse and unmarried children listed on your asylum application. Acting quickly is particularly important for children who were under 21 at the time of filing but have since turned 21.
5. Refugee Travel Documents
Asylees can apply for a Refugee Travel Document upon receiving asylum approval. However, it is essential not to use this document to return to your home country, as doing so may jeopardize your asylum status.
